Illegal?!

So how come my local Silvercoin that used to be full of teenage Chav's Is now almost Chav free as it's now over 18's only since September 1st even though the arcade is 70% full of £5 JP's and several pool tables and arcade games ?

maybe they were playing machines they shouldnt be all the time; or putting off people who DO play the bigguns?

Nope see link.

If theres a anything above £35 in there under 18's are not allowed. The only way around it is if you had a licence granted before 27th april 2007 you can still continue but your chances of getting your licence renewed are 0%

Obviously a cafe is not an arcade, neither is rileys so either
a) theres a loophole somewhere
b)they're keeping the machines till the llicence runs out then getting rid.

So what will happen to Riely's? My local one caters for a lot of kids, especially at weekends and holidays.

Gaz, your drifting off point of what you stated:
If an establishment is frequented by minors then a Fruit machine with a JP higher than £5 is illegal
Its not illegal, that PDF document relates to what is entitled as an 'arcade', not an establishment.

Going back to the original point, yes, any establishment may *apply* for any license, and club licenses are granted not often, but is usually based Dependant on market, location and annual projection.

You cannot apply for a gaming machine licence until you have a local authority permit first,and no councils are granting club machine permits to cafes,Period.
Councils all over the country have been raiding such establishments inc taxi offices,fish and chip,kebab shops etc,where the public has access to play, and confiscating all illegal and unlicenced machines,and deny the future applications of machine permits to cut down the access of gambling machines to children.
If any club with a membership has machines,the rules of the gaming act still apply as to the minimum age of the player.

A Green Lane cafe is facing a £1,000 bill this week after being convicted for illegally operating a gaming machine.
Bambinos Cafe, at 733 Green Lane, Dagenham, was caught with an illegal fruit machine on two occasions by officers from Barking and Dagenham Council's licensing team. They visited the premises, which are operated by Memis Gokensel, twice in October last year, finding the unlicensed fruit machine in use on both occasions. Officers were surprised to find the machine still in use on their second visit (24 October) because they had given Gokensel a clear warning on their first (13 October).
They had explained that fruit machines such as this one need a licence from the local authority. They also notified the cafe owner that the machine, offering a cash prize of £25, could not be kept in a take away. Food premises such as Bambinos Cafe are only allowed to keep machines offering a cash prize of no more than £5, according to the 1968 Gaming Act.
Gokensel attended Barking Magistrates Court on 16 February 2007, pleading guilty to both offences.
He offered in mitigation that he had not understood the purpose of the official warning and had been misled by the person who supplied the machine. Gokensel also claimed that it was his daughter and not him who switched on the fruit machine on the second occasion.Finding the cafe owner guilty on both counts, the court fined him £500 and ordered him to pay the Council's costs of £500.
Officers hope that the prosecution will serve as a warning to other take away owners and encourage them to take their responsibilities seriously.

My point was I know I read a legislation somewhere that states that the new laws as of september the 1st protect minors fron exposure to fruit machines above £5 JP cash payout. So in a cafe it will be illegal, maybe not now but soon enough. Rileys is an interesting point though. Being a membership premises it will have different laws.
