Its because an swp isnt classed as gambling as in theory if you knew the awnsers you would win every time where as an awp the result is decided by the machine. Its why pubs have signs saying games of skill can be played for small stakes and no licence is needed for that (its covered under the alcohol one) as there was a case about 100 years ago where people were playing darts for money and they were accused of gambling but the guy asked the magistrate if he could bring a dart board in to court to demonstrate that it was skill and not fixed odds betting to which the magistrate asked him to hit certain sections of the board which he did.
